General Terms and Conditions of Coffee-Lab s.r.o. for the sale of goods through the online store www.c
§ 1 Validity and Definition of Terms
Coffee-Lab s.r.o., with its registered office at Křížová cesta 222, 37804 Chlum u Třeboně, Czech Republic, VAT ID CZ04185137 (hereinafter referred to as the “Seller” or “Coffee-Lab”), operates an online store at www.coffee-lab.cz focused on the sale of specialty coffee, coffee accessories, and related products.
These Terms and Conditions govern the mutual rights and obligations between the Seller and the customer (hereinafter referred to as the “Buyer” or “Customer”) when purchasing goods through the online store.
For the purposes of these Terms and Conditions, a consumer is understood to mean a natural person who enters into a contract outside the scope of their business activity or independent professional practice.
Legal relations between the Seller and the consumer are governed in particular by Act No. 89/2012 Coll., the Civil Code, and Act No. 634/1992 Coll., on Consumer Protection, as amended.
§ 2 Conclusion of the Purchase Agreement and Storage of Contract Text
Once the customer finds the desired product on the website, they may add it to the shopping cart using the relevant button. By clicking on the shopping cart, the customer can review the selected products and proceed to the checkout process.
In the next step, the customer fills in the required information, in particular their name, delivery address, selected shipping method, and payment method. Before completing the order, the customer has the opportunity to review and correct all entered information.
By clicking the button to complete the order, the customer submits a binding offer to conclude a purchase agreement. The purchase agreement is concluded at the moment the Seller confirms the order, which is sent to the customer by email.
The automatic confirmation of receipt of the order does not constitute acceptance of the offer, but only confirmation that the order has been received.
The order details and the current version of the Terms and Conditions are sent to the customer by email so that they may save them. The Seller does not separately archive the contract text.
§ 3 Subject of the Agreement
The subject of the agreement is the purchase of goods offered in the online store, in particular specialty coffee, coffee accessories, and products related to coffee preparation.
We always prepare coffee fresh after receiving the order. This includes, in particular, the roasting process and, if required, grinding the coffee according to the customer’s preferences.
§ 4 Price, Payment and Delivery of Goods
The prices listed on the website are final and include all statutory charges, including value added tax (VAT).
The purchase price is payable before the goods are delivered. Payment may be made using the payment methods available in the online store, such as credit card payment, bank transfer, or online payment services.
Shipping costs may be added to the stated price. The amount of shipping costs is always clearly displayed to the customer during the checkout process before the order is completed.
Unless otherwise stated in the product description, the goods are usually prepared for shipment within two to four business days after receipt of payment. Every coffee order is freshly roasted, and if required, also ground and packed only after the order has been received. For this reason, we kindly ask for your understanding that coffee cannot be shipped immediately.
§ 5 Personal Data Protection
Customers’ personal data are collected, stored, and processed solely for the purpose of processing orders, communicating with customers, and fulfilling the Seller’s legal obligations.
The controller of personal data is Coffee-Lab s.r.o., Křížová cesta 222, 37804 Chlum u Třeboně, Czech Republic.
The processing of personal data is governed by the applicable legal regulations, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR). The customer has the right to request information about the processing of their personal data or request its correction or deletion.
§ 6 Right of Withdrawal
The consumer has the right to withdraw from the purchase agreement without giving any reason within fourteen days from the date of receiving the goods.
To exercise the right of withdrawal, the customer must inform the Seller of their decision to withdraw from the agreement by means of a clear statement, for example by letter or email sent to info@coffee-lab.cz.
If the customer withdraws from the agreement, the Seller shall refund all payments received, including delivery costs, without undue delay and no later than fourteen days from the day on which the Seller received the notice of withdrawal. The Seller may withhold the refund until the returned goods have been received or until the customer provides proof that the goods have been sent back.
The customer bears the costs of returning the goods.
§ 7 Exceptions to the Right of Withdrawal
The consumer may not withdraw from the agreement in cases stipulated by law, in particular in the case of goods customized according to the customer’s wishes or goods subject to rapid deterioration.
This may apply, for example, to freshly roasted coffee prepared according to a specific customer order, especially if the coffee has been ground upon request.
§ 8 Liability
The Seller shall be liable for damages only to the extent provided by applicable legal regulations. In cases of slight negligence, the Seller shall only be liable for breaches of essential contractual obligations and only to the extent of damages that could reasonably have been foreseen at the time the agreement was concluded.
§ 9 Language of the Agreement
The language of the agreement is Czech. In the event that other language versions are available, the Czech version shall prevail.
§ 10 Complaints and Customer Service
In the event of questions, complaints, or claims, the customer may contact the Seller’s customer service by email at info@coffee-lab.cz or by phone at +420 608 824 721.
Complaints are handled in accordance with the relevant provisions of the Civil Code.
§ 11 Out-of-Court Dispute Resolution
In the event of a consumer dispute, the customer has the right to contact the out-of-court dispute resolution body, which is the Czech Trade Inspection Authority, with its registered office at Štěpánská 15, Prague 2, website www.coi.cz.
